Release and Waiver of Liability

I acknowledge and agree that participation in activities at Willoughby Pickleball LLC (hereinafter referred to as “Willoughby Pickleball”) involves inherent risks. In consideration of the services provided by Willoughby Pickleball, including its agents, officers, participants, consultants, employees, and others acting on its behalf, I agree as follows:

1. Assumption of Risk
   I, (participant 18 years or older or parent/legal guardian of the listed minor), understand that I will be engaging in activities that may involve a risk of serious injury. This risk may arise from my actions or inactions, the actions or inactions of others, the conditions of the premises, or the equipment used. Other unforeseeable risks may also exist. These risks may include but are not limited to the activity’s nature, defects or conditions in equipment or property supplied by Willoughby Pickleball, actions of other participants, employees, or agents, and conditions of the facility or surrounding grounds.
2. Acceptance of Risk
   I expressly accept and assume all risks associated with this activity. I participate voluntarily and elect to take personal responsibility for any resulting injury or damage.
3. Release and Waiver of Liability
   On behalf of myself, my children, parents, heirs, assigns, and personal representatives, I release, waive, discharge, indemnify, and hold harmless Willoughby Pickleball, its officers, directors, agents, employees, affiliates, and other participants, as well as operators or lessors of premises used for events, from all liability for claims, demands, or causes of action connected to my participation in this activity or my use of Willoughby Pickleball equipment or facilities.
4. Insurance and Medical Certification
   I certify that I have adequate insurance to cover any injury or damage that may occur while participating or, if not, I agree to bear the cost of such injury or damage. I further certify that I have no medical or physical conditions that would affect my safety during this activity, or I am willing to assume all risks related to such conditions.
5. Age and Consent for Minors
   I certify that I am at least 18 years old, or I am the parent or legal guardian of the participant under 18. I authorize Willoughby Pickleball to administer basic first aid and to contact emergency services as needed.
6. Adherence to Rules
   I confirm that I have received the rules and regulations for pickleball court use and agree to follow them.
7. Photo/Video Release
   I grant Willoughby Pickleball the irrevocable right to use photos or videos of me in any form of media for marketing or other lawful purposes, and I waive any right to inspect or approve any resulting product.

Acknowledgment of Waiver
By signing this document, I acknowledge that if injury or property damage occurs during my participation, a court may find that I waived my right to pursue a lawsuit against Willoughby Pickleball and related parties based on any claims released herein.

I HAVE HAD SUFFICIENT TIME TO READ THIS DOCUMENT, AND I AGREE TO BE BOUND BY ITS TERMS.
